Introduction<\/b><\/h2>\n

<\/b><\/div>\n

In addition to these <\/span>General Terms and Conditions of Contract<\/b>, the following form an integral part of this contract for the sale of a package travel: the description of the package contained in the official catalogues of <\/span>Ermesia Viaggi Srl<\/b>, on the company website <\/span>www.ermesia.com<\/b>, in the travel programmes and in the personalised communications sent to customers, as well as the booking confirmation of the services requested by the traveller.<\/span><\/p>\n

The terms and information set out in the aforementioned promotional and contractual materials form an integral part of the contract, pursuant to Art. 34 of <\/span>Legislative Decree 79\/2011 \u2013 Italian Tourism Code<\/b>, unless they have subsequently been amended and the traveller was specifically informed of this before the contract was concluded, or the amendments were made with the prior written agreement of the parties.<\/span><\/p>\n


<\/span><\/p>\n

The <\/span>Ermesia General Terms and Conditions of Contract<\/b> are subject to change as a result of legislative, regulatory or operational changes, and shall apply in the version published on <\/span>www.ermesia.com<\/b> at the time the package is booked.<\/span><\/p>\n

Signature of the <\/span>proposal to purchase a package travel<\/b> by the traveller or by the authorised representative (e.g. school, organisation or intermediary agency) constitutes full and unconditional acceptance, on their own behalf and on behalf of all named participants, of the travel programme, the pre-contractual information and these General Terms and Conditions, pursuant to the <\/span>Italian Tourism Code<\/b>.<\/span><\/p>\n

The contract is deemed concluded when the booking is confirmed by <\/span>Ermesia Viaggi Srl<\/b>, upon simultaneous receipt of the deposit or of the agreed payment.<\/span><\/p>\n

1. Legal sources<\/b><\/h3>\n

The sale of package travel involving services to be provided both in Italy and abroad is governed by the <\/span>Italian Tourism Code<\/b> (Legislative Decree no. 79 of 23 May 2011, Articles 32 to 51-novies), as amended by <\/span>Legislative Decree no. 62 of 21 May 2018<\/b>, which transposes and implements <\/span>Directive (EU) 2015\/2302<\/b> on package travel and linked travel arrangements.<\/span><\/p>\n

For matters not expressly provided for, the provisions of the <\/span>Italian Civil Code<\/b> on agency, carriage, contracts for works and the supply of services shall apply, as well as any other applicable rules of Italian and European Union law.<\/span><\/p>\n

The travel contract entered into between <\/span>Ermesia Viaggi Srl<\/b> and the traveller is also governed by the national, regional and municipal provisions regulating the activity of travel and tourism agencies, by these <\/span>General Terms and Conditions of Contract<\/b>, by the pre-contractual information provided pursuant to Art. 34 of the Tourism Code and by any specific agreements set out in the booking confirmation.<\/span><\/p>\n

In the event of the organiser’s insolvency or bankruptcy, this guarantee ensures the refund of the sums paid and the immediate repatriation of travellers.<\/span><\/p>\n

Optional insurance:<\/b><\/p>\n

For each trip, additional policies covering personal risks such as cancellation, accidents, illness, baggage and assistance may be taken out at the request of the traveller or the commissioning school. The details and specific conditions of the optional cover are communicated and delivered together with the travel documents.<\/span><\/p>\n

<\/span><\/p>\n

3. Definitions<\/b><\/h3>\n

For the purposes of these General Terms and Conditions of Contract:<\/span><\/p>\n

    \n
  1. a) Trader:<\/b> means any natural or legal person, whether public or private, who, in the course of their commercial, industrial, craft or professional activity, acts, including through another person acting in their name or on their behalf, as organiser, retailer, trader facilitating linked travel arrangements or travel service provider, in accordance with the legislation in force.<\/span><\/li>\n
  2. b) Organiser:<\/b> means a trader who combines packages and sells or offers them for sale, either directly or through or together with another trader, or the trader who transmits the traveller’s data to another trader.<\/span><\/li>\n<\/ol>\n

    In this contract, the <\/span>organiser<\/b> is <\/span>Ermesia Viaggi Srl<\/b>.<\/span><\/p>\n

      \n
    1. c) Retailer:<\/b> means a trader other than the organiser who sells or offers for sale packages combined by an organiser.<\/span><\/li>\n
    2. d) Traveller:<\/b> means any person who is seeking to conclude a travel contract, or concludes a contract, or is entitled to travel on the basis of a contract concluded, within the scope of the package travel legislation.<\/span><\/li>\n
    3. e) Establishment:<\/b> means an establishment as defined in Art. 8, letter e) of Legislative Decree no. 59 of 26 March 2010.<\/span><\/li>\n
    4. f) Durable medium:<\/b> means any instrument which enables the traveller or the trader to store information addressed personally to them in a way accessible for future reference for a period of time adequate for the purposes of the information, and which allows the unchanged reproduction of the information stored.<\/span><\/li>\n
    5. g) Unavoidable and extraordinary circumstances:<\/b> means a situation beyond the control of the party invoking it, the consequences of which could not have been avoided even if all reasonable measures had been taken.<\/span><\/li>\n
    6. h) Lack of conformity:<\/b> means a failure to perform the travel services included in a package as provided for in the contract.<\/span><\/li>\n
    7. i) Retail premises:<\/b> means any movable or immovable retail premises, or a retail website or similar online sales facility, including where several retail websites are presented to travellers as a single facility.<\/span><\/li>\n
    8. l) Repatriation:<\/b> means the traveller’s return to the place of departure or to another place agreed by the contracting parties.<\/span><\/li>\n<\/ol>\n

      4. Definition of package travel<\/b><\/h3>\n

      Pursuant to Article 33, paragraph 1 of the <\/span>Italian Tourism Code<\/b>, a \n<\/span>package<\/span><\/i> is a combination of at least two different types of travel services for the purpose of the same trip or holiday, where that combination is put together by a single trader (organiser) or sold, offered for sale or charged at an inclusive or total price.<\/span><\/p>\n

      The travel services that may be combined in a package are:<\/span><\/p>\n

        \n
      1. a) the carriage of passengers;<\/span><\/li>\n
      2. b) accommodation which is not intrinsically part of the carriage of passengers and is not for residential or long-stay purposes;<\/span><\/li>\n
      3. c) the rental of cars, other motor vehicles or motorcycles requiring a category A driving licence;<\/span><\/li>\n
      4. d) any other tourist service which is not intrinsically part of one of the services referred to in the previous points and is not a financial or insurance service, where that service accounts for a significant proportion of the package or is advertised as an essential feature of it.<\/span><\/li>\n<\/ol>\n
