General Terms and Conditions of Contract

Introduction

In addition to these General Terms and Conditions of Contract, the following form an integral part of this contract for the sale of a package travel: the description of the package contained in the official catalogues of Ermesia Viaggi Srl, on the company website www.ermesia.com, in the travel programmes and in the personalised communications sent to customers, as well as the booking confirmation of the services requested by the traveller.

The terms and information set out in the aforementioned promotional and contractual materials form an integral part of the contract, pursuant to Art. 34 of Legislative Decree 79/2011 – Italian Tourism Code, unless they have subsequently been amended and the traveller was specifically informed of this before the contract was concluded, or the amendments were made with the prior written agreement of the parties.

The Ermesia General Terms and Conditions of Contract are subject to change as a result of legislative, regulatory or operational changes, and shall apply in the version published on www.ermesia.com at the time the package is booked.

Signature of the proposal to purchase a package travel by the traveller or by the authorised representative (e.g. school, organisation or intermediary agency) constitutes full and unconditional acceptance, on their own behalf and on behalf of all named participants, of the travel programme, the pre-contractual information and these General Terms and Conditions, pursuant to the Italian Tourism Code.

The contract is deemed concluded when the booking is confirmed by Ermesia Viaggi Srl, upon simultaneous receipt of the deposit or of the agreed payment.

For matters not expressly provided for, the provisions of the Italian Civil Code on agency, carriage, contracts for works and the supply of services shall apply, as well as any other applicable rules of Italian and European Union law.

The travel contract entered into between Ermesia Viaggi Srl and the traveller is also governed by the national, regional and municipal provisions regulating the activity of travel and tourism agencies, by these General Terms and Conditions of Contract, by the pre-contractual information provided pursuant to Art. 34 of the Tourism Code and by any specific agreements set out in the booking confirmation.

  2. b) Organiser: means a trader who combines packages and sells or offers them for sale, either directly or through or together with another trader, or the trader who transmits the traveller’s data to another trader.

In this contract, the organiser is Ermesia Viaggi Srl.

4. Definition of package travel

Pursuant to Article 33, paragraph 1 of the Italian Tourism Code, a package is a combination of at least two different types of travel services for the purpose of the same trip or holiday, where that combination is put together by a single trader (organiser) or sold, offered for sale or charged at an inclusive or total price.

The travel services that may be combined in a package are:

  1. a) the carriage of passengers;
  2. b) accommodation which is not intrinsically part of the carriage of passengers and is not for residential or long-stay purposes;
  3. c) the rental of cars, other motor vehicles or motorcycles requiring a category A driving licence;
  4. d) any other tourist service which is not intrinsically part of one of the services referred to in the previous points and is not a financial or insurance service, where that service accounts for a significant proportion of the package or is advertised as an essential feature of it.

A package exists in the following cases:

  • where the services are combined by a single trader, including at the request of or in accordance with the selection of the traveller, before a single contract for all the services is concluded;
  • where the services, even if concluded under separate contracts with individual providers, are:
     • purchased from a single point of sale and selected before the traveller agrees to pay;
     • offered, sold or charged at an inclusive or total price;
     • advertised or sold under the term “package” or a similar term;
     • combined after the conclusion of a contract by which the trader entitles the traveller to choose among a selection of travel services;
     • purchased from separate traders through linked online booking processes, where the traveller’s name, payment details and email address are transmitted from one trader to another and the contract with the latter is concluded within 24 hours of the confirmation of the first service.

A combination of travel services lasting less than 24 hours without overnight accommodation does not constitute a package, unless it is a combined trip for training or school purposes, or in any case where the service is organised by a professional operator such as Ermesia Viaggi Srl.

5. Content of the contract – Purchase proposal and documents to be provided

When the package travel contract is concluded or, in any case, as soon as possible thereafter, Ermesia Viaggi Srl, as organiser, provides the traveller with a copy or confirmation of the contract on a durable medium, pursuant to Article 36 of the Tourism Code.

The travel contract must contain all the essential elements, including:

  • the travel destination(s);
  • the duration, with start and end dates;
  • the means, characteristics and categories of transport used;
  • the accommodation, its location, category or level of comfort and main features;
  • the meals provided;
  • the visits, excursions or other services included in the total agreed price;
  • the total price of the package, the payment terms and any additional costs not included;
  • the minimum number of participants required for the trip to take place, if applicable, and the deadline by which the contract may be terminated if this number is not reached;
  • the deadlines for communicating any changes;
  • the details of the mandatory insurance cover and of the guarantee under Art. 47 of the Tourism Code;
  • the procedures for handling complaints;
  • the clauses on cancellation charges and on the traveller’s rights in the event of changes or cancellations.

The traveller is entitled to receive a paper copy of the contract where it was concluded in the simultaneous physical presence of the parties, or a digital copy in the case of online bookings.

For contracts negotiated off business premises, such as those entered into with schools or organisations, the contractual confirmation is provided on paper or, if the traveller agrees, on another durable medium, and must contain all the elements set out in the Tourism Code and in these general terms and conditions.

The travel contract constitutes a valid title to access the protections provided by the Ermesia Guarantee Fund managed by Garanzia Viaggi S.r.l., pursuant to Article 47 of the Tourism Code.

6. Information for the traveller – Technical data sheet

Before the start of the trip, Ermesia Viaggi Srl, as organiser, provides the traveller with all the mandatory information required by Articles 34 and 36 of the Italian Tourism Code, including information on the main characteristics of the travel services, on how the trip will be carried out and on the traveller’s rights and obligations.

6.1. Mandatory pre-contractual information

  1. a) the destination, itinerary and periods of stay, with the relevant dates and duration;
  2. b) the means, characteristics and categories of transport, and the places of departure and return;
  3. c) the location, main features and, where applicable, the tourist category of the accommodation under the rules of the country of destination;
  4. d) the meals provided and any board options;
  5. e) the visits, excursions or other services included in the total agreed price;
  6. f) the travel services provided to the traveller as part of a group and, where applicable, the approximate size of the group;
  7. g) the language in which the services are provided and, where possible, the qualifications of the guides or tour leaders;

  9. i) the total price of the package, inclusive of taxes, fees, duties and other additional costs, or, where these cannot be calculated before the contract is concluded, an indication of the type of costs that may apply;
  10. l) the payment arrangements, including the amount or percentage to be paid as a deposit and the payment schedule;
  11. m) the minimum number of participants required for the trip to take place and the deadline by which the organiser may cancel if that number is not reached;
  12. n) passport and visa requirements, including the time needed to obtain them, and the health formalities of the country of destination;
  13. o) the cancellation terms, with the related charges and deadlines;
  14. p) the possibility of taking out optional insurance covering the costs of cancellation or assistance, including repatriation, in the event of accident, illness or death;
  15. q) the details of the organiser’s insolvency or bankruptcy protection and insurance cover.

6.2. Communications after booking

After the contract has been concluded and before departure, Ermesia Viaggi Srl will notify the traveller, on a durable medium, of any changes concerning:

  • the identity of the operating air carrier, pursuant to Regulation (EC) no. 2111/2005;
  • the address and telephone number of local representatives, guides or correspondents;
  • timetables, intermediate stops and connections (including approximate ones);
  • updated information on passports, visas and health formalities.

6.3. Right of withdrawal for contracts negotiated off business premises

In the case of contracts negotiated off business premises, the traveller has the right to withdraw without penalty within five days of the date the contract was concluded or of the date on which they receive the contractual terms and preliminary information, if later.

The right of withdrawal is excluded for promotional offers at rates significantly lower than current rates, where the promotional nature and the exclusion of the right of withdrawal are clearly indicated in the documentation.

6.4. Ermesia technical data sheet

Administrative authorisation: SCIA notification ref. no. RI/PRA/2025/687845/100 – File code M25912P2240 – issued on 12/09/2025.

Professional Liability insurance policy: Policy no. 450727028 – limit of € 5,000,000.00.

Traveller guarantee under Art. 47 of the Tourism Code: Garanzia Viaggi S.r.l. – Certificate no. A/113.6337/6/2025 – www.garanziaviaggi.it

Validity of this document: from 01.09.2025 to 31.08.2026, unless subsequently updated on www.ermesia.com.

6.5. Exchange rates and fuel costs

Any changes in exchange rates or fuel costs may result in price adjustments, within the limits and in the manner set out in Article 8.

6.6. Minimum number of participants

Unless otherwise stated in the programme, group trips organised by Ermesia Viaggi Srl are not subject to a minimum number of participants.

Any exceptions or specific conditions will be stated in the trip data sheet or in the individual contract.

7. Payments

Unless expressly stated otherwise in the travel documents or in the confirmation communications, upon signing the proposal to purchase the package a deposit of 30% of the total participation fee must be paid. This amount is paid as a confirmatory deposit and as an advance on the price.

The balance must be paid no later than 30 (thirty) days before the departure date. For bookings made after this deadline, payment must be made in full at the time of confirmation.

Payment can be made by bank transfer to:

ERMESIA VIAGGI SRL

Banca Popolare di Sondrio

IBAN: IT65 S056 9601 6330 0000 2827 X66

Payment reference: [Customer name] – [Destination / travel period]

Failure by Ermesia Viaggi Srl to receive the sums due within the above deadlines will result in the automatic termination of the contract, to be notified in writing, including by email or PEC, with the cancellation charges set out in Article 10 of this contract being applied.

Failure to pay by the traveller or by the intermediary through whom the booking was made is equivalent to withdrawal by the traveller, with the cancellation charges indicated being applied.

The balance of the price is deemed paid when the sums are received by the organiser, either directly from the traveller or through the designated intermediary.

Any late payments not authorised by Ermesia Viaggi Srl may result in the automatic cancellation of the booked services, with no right to a refund of the sums already paid.

8. Price

The price of the package is set out in the contract with reference to the catalogues, the travel programmes published on www.ermesia.com, official communications or specific personalised offers sent to the traveller or to the requesting school.

The total price of the package consists of:

  1. a) the participation fee, calculated on the basis of the services included (transport, accommodation, meals, visits, activities and ancillary services);
  2. b) any optional insurance policies (cancellation, medical, baggage, etc.);
  3. c) airport taxes and fees, port or entry fees, where applicable;
  4. d) any visas, tourist taxes, local costs or supplements specifically indicated in the programmes;
  5. e) administrative and booking handling fees, where applicable.

The price may be increased or decreased only as a direct consequence of changes concerning:

  • the cost of transport, including the cost of fuel or other power sources;
  • taxes and fees relating to transport (landing, disembarkation or embarkation taxes at ports and airports);
  • the exchange rates applicable to the package concerned.

These changes are applied proportionally and are calculated according to the criteria and methods set out in the Technical Data Sheet (Art. 6.5).

In any event, the price may not be increased in the 20 (twenty) days preceding departure, and any revision may not exceed 8% of the original price of the package.

In the event of a price reduction, the organiser is entitled to deduct the actual administrative expenses incurred in making the refund due to the traveller, providing proof thereof on request.

Any price change will be notified on a durable medium (email or PEC), clearly stating the reasons for the change and how it was calculated, at least 20 days before departure.

If the price increase exceeds 8%, the traveller will be entitled to accept the change or to withdraw from the contract without paying any penalty, with the right to a full refund of the sums already paid, as provided for in Article 9.

The price is expressed in euros (€) and includes value added tax (VAT).

9. Changes to or cancellation of the package before departure

Ermesia Viaggi Srl reserves the right to unilaterally change, at any time before departure, certain terms of the contract other than the price, where the change is insignificant and does not substantially affect the overall travel experience.

The traveller will be notified of this on a durable medium (email or PEC) in a clear, comprehensible and timely manner.

If, before departure, the organiser:

  1. a) is constrained to significantly alter one or more of the main characteristics of the travel services referred to in Art. 34, paragraph 1, letter a) of the Tourism Code;
  2. b) cannot fulfil the special requirements requested by the traveller and already accepted by the organiser;
  3. c) proposes a price increase of more than 8% of the total price of the package;

the traveller may, within two (2) working days of receiving the notification:

  • accept the proposed change; or
  • withdraw from the contract without penalty, with the right to a full refund of the sums already paid.

In the event of withdrawal, Ermesia Viaggi Srl may offer the traveller a substitute package of equivalent or higher quality at no extra cost, or a package of lower quality with an appropriate price reduction.

If the traveller does not accept the alternative offer, the organiser will provide a full refund of all sums received, within 14 (fourteen) days of withdrawal, without any further compensation.

No compensation is due in the following cases:

  • where the cancellation is due to the minimum number of participants not being reached, if this condition was stated in the programme and the organiser informed the traveller within the statutory deadlines (20 days before departure for trips of more than 6 days, 7 days for trips of 2–6 days, 48 hours for trips of less than 2 days);
  • where the cancellation or change results from unavoidable and extraordinary circumstances or force majeure;
  • where the cancellation is attributable to the traveller or to third parties unconnected with the provision of the travel services included in the package.

In any other case of cancellation attributable to Ermesia Viaggi Srl, the traveller will be entitled to a refund of twice the sums already paid to and received by the organiser, provided however that this amount does not exceed twice what the traveller would have had to pay as a cancellation charge had they withdrawn, as provided for in Article 10.

10. Withdrawal by the traveller

The traveller may withdraw from the contract without paying any penalty in the following cases:

  1. a) a price increase of more than 8% of the total price of the package;
  2. b) a significant change to one or more essential elements of the contract, objectively fundamental to the enjoyment of the package, proposed by the organiser after the contract was concluded but before departure, and not accepted by the traveller;
  3. c) the organiser’s inability to fulfil the special requirements requested by the traveller and already accepted by Ermesia Viaggi Srl;
  4. d) the occurrence, at the place of destination or in its immediate vicinity, of unavoidable and extraordinary circumstances significantly affecting the performance of the package or the carriage of passengers to the destination.

In such cases, the traveller is entitled:

  • to a full refund of the sums already paid, without any additional compensation,
  • or, where possible, to a substitute package of equivalent or higher quality, or of lower quality with an appropriate price reduction, at their choice.

10.1. Withdrawal subject to charges

Outside the cases indicated above, a traveller who withdraws from the contract for any reason, including unforeseen or supervening reasons, will be required to pay the cancellation charges set out below, regardless of the payment of the deposit provided for in Article 7.

The calculation of days does not include the day of withdrawal, notice of which must be received on a working day prior to the start of the trip.

Standard cancellation charges (applicable to coach and air travel):
  • up to 28 days before departure → charge of 20% of the participation fee and supplements;
  • from 27 to 21 days before departure → charge of 30%;
  • from 20 to 11 days before departure → charge of 50%;
  • from 10 to 3 days before departure → charge of 70%;
  • from 2 days before departure or in case of no-show → charge of 100% of the participation fee and supplements.

In addition to the percentages listed above, the following will be charged in full:

  • optional insurance premiums, if taken out;
  • charges imposed by airlines or rail carriers where tickets were issued in advance;
  • non-refundable costs of confirmed services (museums, restaurants, admission tickets, etc.), where documented.

10.2. Withdrawal by the organiser

Ermesia Viaggi Srl may withdraw from the contract, with a full refund of the sums paid by the traveller but without additional compensation, in the following cases:

  • the minimum number of participants (where provided for in the programme) is not reached, notified within the deadlines set out in Art. 9;
  • the occurrence of unavoidable and extraordinary circumstances that make it impossible to carry out the trip.

In such cases, the organiser will make the refund within 14 (fourteen) days of the date of withdrawal.

10.3. Right of withdrawal for off-premises contracts

In the case of contracts concluded off business premises, pursuant to Art. 41, paragraph 7 of the Tourism Code, the traveller has the right to withdraw without penalty within five (5) days of the conclusion of the contract or of receipt of the contractual terms and preliminary information, if later.

The right of withdrawal is excluded for packages sold at promotional rates significantly lower than current offers, provided that this exclusion is clearly stated in the contractual documentation.

11. Organiser’s liability for improper performance and supervening impossibility during performance – Traveller’s obligations – Timely complaints

11.1. Organiser’s liability

Ermesia Viaggi Srl, as organiser, is responsible for the performance of the travel services included in the package travel contract, regardless of whether those services are to be performed directly or by third-party service providers, auxiliaries or subcontractors, pursuant to Article 1228 of the Italian Civil Code.

The organiser is liable for non-performance or improper performance of the contract, unless it proves that:

  • the lack of conformity is attributable to the traveller;
  • the lack of conformity is attributable to a third party unconnected with the provision of the travel services and is unforeseeable or unavoidable;
  • the lack of conformity is due to unavoidable and extraordinary circumstances.

In such cases, the organiser is not required to compensate for damage resulting from non-performance or improper performance, but remains obliged to provide the traveller with appropriate assistance pursuant to Article 18.

11.2. Obligation to report promptly

Pursuant to Articles 1175 and 1375 of the Italian Civil Code, the traveller must act fairly and in good faith, promptly informing Ermesia Viaggi Srl or the local representative of any lack of conformity encountered during the performance of the package.

The complaint must be made without undue delay, in writing (email or a traceable message) or, failing that, verbally to the guide or local contact, so that the organiser can remedy it promptly.

Failure to report, or late reporting of, a lack of conformity may reduce or exclude the traveller’s right to a price reduction or compensation for damage, where prompt action by the organiser would have avoided or limited the damage.

11.3. Remedies for lack of conformity

If any of the travel services is not performed in accordance with the contract, Ermesia Viaggi Srl will remedy the lack of conformity, unless this is impossible or entails disproportionate costs, taking into account the nature and extent of the lack of conformity.

If the organiser fails to remedy it within a reasonable period set by the traveller, the traveller may:

  • remedy the lack of conformity themselves and request reimbursement of the necessary expenses, provided they are reasonable and documented;
  • obtain a price reduction proportionate to the non-performance;
  • claim, where damage has occurred, compensation in accordance with Articles 43 and 46 of the Tourism Code.

11.4. Termination for significant non-performance

Where a lack of conformity constitutes significant non-performance and the organiser fails to remedy it promptly, the traveller may terminate the contract with immediate effect, requesting, where due, a price reduction and compensation for damage, without prejudice to repatriation if included in the package.

11.5. Supervening impossibility of performance

If, due to supervening circumstances not attributable to the organiser, it becomes impossible to provide a significant proportion of the agreed services, Ermesia Viaggi Srl will offer, at no extra cost, alternative arrangements of equivalent or higher quality, where possible, so that the package can continue.

If the proposed arrangements involve services of lower quality, the traveller is entitled to an appropriate price reduction.

The traveller may reject the alternative arrangements only if:

  • they are not comparable to what was agreed in the contract; or
  • the price reduction offered is inadequate.

If it is not possible to offer alternative arrangements, or the traveller rejects them for the reasons above, the organiser will provide, at no additional cost, equivalent transport for the return to the place of departure or to another agreed place, and will refund the difference between the agreed services and those actually provided up to the return.

11.6. Right to compensation

The traveller is entitled to compensation for damage suffered as a result of the lack of conformity, unless the organiser proves that the lack of conformity is attributable to the traveller, to third parties or to unavoidable and extraordinary circumstances.

No compensation is due for damage resulting from the traveller’s negligence or misconduct.

12. Substitutions and booking changes

12.1. Transfer of the contract

The traveller may transfer the package travel contract to another person who satisfies all the conditions applicable to that contract, by giving written notice to Ermesia Viaggi Srl on a durable medium (email or PEC) no later than seven (7) days before the start of the trip.

The transferor and the transferee of the contract are jointly and severally liable to the organiser for payment of the balance of the price and of any fees, charges or additional costs arising from the transfer.

Ermesia Viaggi Srl will inform the transferor of the actual costs of the transfer, which will not exceed the expenses actually incurred for the substitution, and will provide proof of those costs on request (e.g. issue of new travel tickets, ticket reissue costs, updating of insurance or visas).

For packages that include air tickets issued at a special fare, the transfer may require the issue of a new ticket subject to the fares available at the time of the change.

12.2. Changes requested by the traveller

Any change requested by the traveller after the booking has been confirmed will incur an administrative handling fee of €25.00 (twenty-five euros) per person, in addition to any further charges applied by suppliers for the change (airlines, hotels, carriers, museums, etc.).

Ermesia Viaggi Srl is not obliged to accept changes that cannot be technically accommodated. In this case, the traveller may keep the original contract or withdraw subject to the cancellation charges set out in Article 10.

12.3. Substitutions during the trip

Substitutions requested during the trip (for example in the case of early return, late arrival or change of participant) will be accepted only if technically possible and compatible with local regulations, transport schedules and supplier availability.

All additional costs arising from such substitutions or changes shall be borne exclusively by the traveller or by the commissioning school.

13. Travellers’ obligations

13.1. Travel documents and personal requirements

Travellers must hold personal identity documents valid for travel abroad, in accordance with the regulations in force in the countries of destination, including any required visas, permits or health certificates.

For minors under 18, the specific rules issued by the Italian Ministry of the Interior apply, available on the website of the Polizia di Stato ( www.poliziadistato.it).

Minors must hold their own personal document (passport or identity card valid for travel abroad in EU countries). For minors under 14 travelling unaccompanied by their parents or legal guardians, written authorisation from the Judicial Authority is mandatory.

Foreign nationals must check the rules on travel documents independently with their competent consular authorities or embassies.

No liability may be attributed to Ermesia Viaggi Srl or to intermediaries if the traveller is unable to depart owing to missing, insufficient or irregular travel documents.

13.2. Obligation to obtain information in advance

Before departure, travellers must consult the official information on the socio-political, health, climate and security situation of the destination countries, available on the website of the Italian Ministry of Foreign Affairs ( www.viaggiaresicuri.it).

In case of emergency, registration on the “Dove siamo nel mondo” portal is also recommended ( www.dovesiamonelmondo.it).

If, at the date of booking, the country of destination is already subject to an official travel warning, the traveller may not subsequently invoke this circumstance to justify withdrawal without penalty or to obtain a refund of sums paid.

13.3. Conduct during the trip

Travellers must observe the rules of prudence, diligence and good conduct, as well as the instructions given by Ermesia Viaggi Srl, by guides and tour leaders, and the internal regulations of the accommodation facilities and means of transport used.

Ermesia Viaggi Srl reserves the right to remove from the group, without refund, anyone whose behaviour causes serious disturbance, danger or damage to persons, property or the company’s image, or who breaks local laws.

Any damage caused by the traveller to facilities, vehicles or third parties shall be borne directly by the traveller, or by the school in the case of a student group, with an obligation to pay compensation immediately.

13.4. Special requirements and sensitive data

The traveller must notify in writing, before the contract is concluded, any personal needs or special conditions (e.g. pregnancy, disability, food intolerances, medical conditions, medical treatment or religious requirements), by completing and signing the relevant consent form for the processing of special categories of data.

Such requests can only be accommodated if compatible with the type of trip and the facilities involved, and subject to written confirmation by Ermesia Viaggi Srl.

Requests made after booking shall not be binding on the organiser.

13.5. Communications and contact details

At the time of booking, the traveller must provide their direct contact details (email address and mobile number), checking that they are correct, so that any urgent communications during the trip can be transmitted properly.

Ermesia Viaggi Srl shall not be liable for delays or disruption due to incorrect or out-of-date contact details.

13.6. Liability for damage and subrogation

The traveller is liable to Ermesia Viaggi Srl for all damage caused by conduct in breach of the obligations set out in this article.

The traveller must also provide the organiser with all information and documents useful for exercising the right of subrogation against the third parties responsible for the damage.

14. Hotel classification

The official classification of the hotels and accommodation facilities indicated in the travel programmes of Ermesia Viaggi Srl corresponds to the categories officially recognised by the competent authorities of the country in which the service is provided.

Where there is no official classification system recognised by a public authority in the country of destination, or where the facility is marketed as a “holiday village”, Ermesia Viaggi Srl reserves the right to provide, in its information material, a detailed description of the facility, enabling the traveller to make a realistic and informed assessment.

Information on facilities (location, category, services, quality standards, amenities and distances from the main points of interest) is based on data provided by the respective operators and on checks carried out by the organiser, but may change over time for operational or seasonal reasons.

Any differences found on site compared with Italian or European standards cannot be considered a lack of conformity where they are attributable to different local regulations, customs or practices.

15. Liability

15.1. General principle

Ermesia Viaggi Srl, as organiser, is liable for damage caused to the traveller by the total or partial non-performance of the services due under the contract, whether performed directly or through service providers, auxiliaries or agents, unless it proves that the non-performance:

  1. a) is attributable to the traveller;
  2. b) is attributable to a third party unconnected with the provision of the travel services included in the contract and is unforeseeable or unavoidable;
  3. c) is due to unavoidable and extraordinary circumstances within the meaning of Art. 45 of the Tourism Code.

In such cases, Ermesia Viaggi Srl is not required to compensate for damage, but remains obliged to provide the traveller with appropriate assistance pursuant to Article 18 of this contract.

15.2. Liability of the intermediary

The intermediary (retail agency) through which the package was booked, where applicable, is not liable for the organisation and performance of the trip, but solely for the obligations arising from its own intermediation and payment collection activity, within the limits of Art. 50 of the Tourism Code, including the obligations of financial guarantee and assistance under Art. 47.

15.3. Limitation of compensation

The compensation payable by Ermesia Viaggi Srl may in no case exceed:

  • the limits laid down by the International Conventions applicable to the individual services making up the package (e.g. the 1999 Montreal Convention for air transport, the Bern Convention for rail transport, the Brussels Convention for maritime transport);
  • the limits set out in Articles 1783 and 1784 of the Italian Civil Code for liability relating to the custody of and damage to property and baggage;
  • the maximum sums covered by the Professional Liability insurance policy taken out by Ermesia Viaggi Srl (limit of € 5,000,000.00).

No indirect, non-material or consequential damage (such as loss of opportunity, profit or leisure time) is compensable, without prejudice to the right to compensation for a ruined holiday, where established pursuant to Art. 46 of the Tourism Code.

15.4. Exclusion of liability

No liability may be attributed to Ermesia Viaggi Srl for:

  • delays, changes or cancellations due to force majeure (strikes, natural disasters, weather events, government decisions, wars, pandemics, etc.);
  • disruption attributable to transport carriers (air, rail, sea, scheduled coach services) or to public infrastructure operators;
  • loss, theft or damage to the traveller’s baggage, valuables or personal belongings not formally entrusted to the organiser.

15.5. Liability for personal injury

In the event of personal injury or death of the traveller attributable to the organiser or its suppliers, Ermesia Viaggi Srl is liable pursuant to Art. 43 of the Tourism Code, without predetermined limits, within the limits of the insurance cover and of the legislation in force.

16. Limits of compensation and limitation periods

16.1. Limits of compensation

Compensation under Articles 43 and 46 of the Italian Tourism Code and the related limitation periods are governed by the provisions set out therein and, in any case, within the limits established by the international conventions governing the services included in the package, including:

  • Montreal Convention of 28 May 1999 for international air transport;
  • Bern Convention (CIV) for rail transport;
  • Brussels Convention for maritime transport;
  • Paris Convention on the liability of hotel keepers.

For matters not covered by the international conventions, Articles 1783 and 1784 of the Italian Civil Code apply, concerning the hotel keeper’s liability for loss of or damage to items brought by the traveller, unless the damage results from force majeure, the nature of the item or the fault of the customer.

16.2. Compensation for a ruined holiday

The right to compensation for a ruined holiday – consisting of the loss resulting from the failure to enjoy the trip or holiday due to the organiser’s non-performance – is recognised pursuant to Art. 46 of the Tourism Code, provided that the lack of conformity is not insignificant.

Compensation is due within the limits of the duration of the package and must be proportionate to the seriousness of the lack of conformity and to the extent to which the travel experience was compromised.

16.3. Limitation periods

The right to a price reduction or to compensation for damage for changes to the package travel contract or for non-performance is time-barred after two (2) years from the date of the traveller’s return to the place of departure.

The right to compensation for personal injury and for a ruined holiday is time-barred after three (3) years from the date of the traveller’s return, or after the longer period provided for by the rules governing the individual services included in the package.

16.4. Exclusions

The following do not constitute compensable damage:

  • minor inconvenience due to delays or non-substantial changes to services;
  • events attributable to negligent or careless behaviour by the traveller;
  • damage not reported promptly pursuant to Art. 11.

17. Contacting the organiser through the retailer

The traveller may send messages, requests or complaints relating to the performance of the package directly to Ermesia Viaggi Srl, or to the retailer/intermediary from whom they purchased the trip.

In the latter case, the intermediary must forward without delay to the organiser all communications received from the traveller.

For the purposes of complying with statutory deadlines, the date on which the intermediary receives a message, request or complaint from the traveller is considered the date of receipt for the organiser as well, pursuant to Art. 44 of the Tourism Code.

Communications may be sent to Ermesia Viaggi Srl at the following official contact details:

  • PEC: ermesiaviaggisrl@pec.it
  • Dedicated email: info@ermesia.com
  • Postal address: Viale Misurata 34, 20146 Milan (MI)

18. Duty of assistance

18.1. Organiser’s duty of assistance

During the performance of the package, Ermesia Viaggi Srl must provide appropriate assistance without undue delay to a traveller in difficulty, including in the circumstances referred to in Article 42, paragraph 7 of the Tourism Code, in particular by:

  • providing useful information on health services, the competent local authorities and consular assistance;
  • helping the traveller to make urgent long-distance communications;
  • helping to arrange access to alternative travel services and, where necessary, organising an early return.

Assistance is due regardless of liability for the lack of conformity, and aims to reduce the negative effects of emergencies or service disruption.

18.2. Costs of assistance

The organiser may ask the traveller for reimbursement of the costs actually incurred for the assistance provided only if the difficulty was caused intentionally by the traveller or through their gross negligence, in accordance with the principle of proportionality and subject to documentation of the costs.

18.3. Emergency contacts

Ermesia Viaggi Srl provides travellers or school contacts, before departure, with a 24/7 emergency telephone number or other contact, to be used exclusively for urgent reports during the trip.

This information is included in the travel programme and in the departure documents.

18.4. Traveller cooperation

The traveller must cooperate with Ermesia Viaggi Srl, its local representatives and service providers, so that difficulties can be resolved promptly and any damage or disruption minimised.

19. Insurance against cancellation and repatriation costs

19.1. Included or optional insurance cover

Unless otherwise stated in the travel programme, medical, baggage and cancellation insurance cover is not included in the price of the package, but may be taken out by the traveller at the time of booking or later, within the deadlines set by the organiser.

Ermesia Viaggi Srl strongly recommends taking out an appropriate individual or group insurance policy providing, depending on the type of trip:

  • cover for cancellation or curtailment costs for documented reasons (illness, accident, force majeure);
  • cover for medical assistance, medical repatriation or early return;
  • cover for loss, theft or damage to baggage;
  • cover for unforeseen events (delays, quarantines, health restrictions, etc.).

19.2. Professional liability insurance policy

Ermesia Viaggi Srl is covered by Professional Liability insurance policy no. 450727028, taken out with Agenzia Generale di Milano Santa Maria delle Grazie – Allianz S.p.A., with a limit of € 5,000,000.00 per insurance year, covering the risks arising from its activity as a tour organiser, in accordance with Art. 50 of the Tourism Code.

19.3. Individual travel policies

Individual or group policies taken out for individual travellers are issued by partner insurance companies of Ermesia and specified in the travel documents.

The terms, deductibles and claims procedures are those set out in the policy conditions attached or available on the official websites of the insurance companies indicated.

Claims must be reported directly to the insurance company in the manner and to the contacts indicated in the policy documents, Ermesia Viaggi Srl being released from any liability for the handling, assessment or settlement of claims.

22. Operational changes

22.1. Technical and logistical changes

Given the advance notice with which packages are planned and published, Ermesia Viaggi Srl reserves the right to make changes, before departure, to the information contained in its catalogues, programmes or trip data sheets, provided that such changes are insignificant and do not substantially affect the essential characteristics of the package.

Any changes will be communicated to the traveller clearly and precisely, on a durable medium (e.g. by email), stating the nature of the change and any effect on the price.

ADDENDUM – General terms and conditions for the sale of individual travel services

A1. Legal provisions

Contracts for the provision of a transport service only, an accommodation service only, or any other single travel service, since they cannot be classified as organised travel or a package within the meaning of Art. 33, paragraph 1, letter a) of the Italian Tourism Code, do not benefit from the protections granted to travellers by Legislative Decree 79/2011 as amended by Legislative Decree 62/2018 (implementing Directive (EU) 2015/2302).

The retailer who undertakes to procure for third parties, including online, a stand-alone travel service (e.g. air ticket, hotel booking, rail ticket, insurance, transfer) must issue the traveller with the documents relating to the service purchased, showing:

  • the nature of the service;
    the amount paid;
  • the identity of the supplier;
  • any other information useful for the use of the service.

The retailer cannot be considered a tour organiser, and remains liable solely for the performance of its intermediation mandate, as provided for by Art. 50 of the Tourism Code.

Contracts for individual travel services sold by Ermesia Viaggi Srl are also covered by the insolvency or bankruptcy protection pursuant to Art. 47 of the Tourism Code, provided by Garanzia Viaggi S.r.l. (Certificate no. A/113.6337/6/2025 – www.garanziaviaggi.it).

This guarantee ensures the refund of the sums paid and, where applicable, the immediate repatriation of travellers if necessary.

A3. Retailer’s liability

In the case of the sale of individual travel services, Ermesia Viaggi Srl acts as an intermediary and is liable solely for the obligations arising from the mandate received from the traveller and from the suppliers of the service booked.

Any non-performance or non-conformity of the service provided is the sole responsibility of the direct supplier (carrier, hotel, rail company, etc.), whom the traveller must contact to assert their rights.

A4. Mandatory notice (Art. 17, Law 38/2006)

Pursuant to Art. 17 of Law no. 38 of 6 February 2006, travellers are informed that Italian law punishes with imprisonment offences relating to child prostitution and child pornography, even if committed abroad.

A5. Processing of personal data (Privacy)

The personal data provided by the traveller is processed by Ermesia Viaggi Srl as Data Controller, pursuant to Regulation (EU) 2016/679 (GDPR) and Legislative Decree 196/2003 as amended by Legislative Decree 101/2018.

  • no financial limit for damage resulting from the death, wounding or bodily injury of the passenger;
  • liability for delay in carriage up to €5,000;
  • liability for destruction, loss or damage to baggage up to €1,200.

A special declaration of interest for baggage can be made, or specific insurance taken out, at check-in.

Carriers that are not party to the Montreal Convention may apply different regimes.
